For a third time the US Supreme Court has ruled BUSH WORLD GULAG DETENTION is Unconstitutional.

The right wing smear machine is now criticizing the US Supreme Court for “freeing terrorists”. What’s bizarre is that the Fascist media are saying the “terrorists” will go “back to Iraq”.

There are NO IRAQI’S IN GITMO as far as I know. Iraqis’ were NOT INVOLVED in the attacks on September 11, 2001.

REPEATING - There were ZERO Iraqi’s involved in the attacks of September 11, 2001. Iraq was a secular nation in 2001. Radicals were not tolerated in Iraq until we bombed IRAQ, Invaded Iraq, and began to OCCUPY Iraq. WE radicalized Iraq. The Saudi’s opened their borders to let out the Wahhabi Fundamentalists Jihadists and let them enter IRAQ to fight AMERICANS.

The number of foreign fighters in Iraq was ZERO prior to our invasion. The number of “Al Qaeda in Iraq” are not known although estimated to be less than 2% of all fighters.

The lions share of detainees in GITMO were picked up in Afghanistan. Many were sold to the US by Afghan war lords.

The best information available comes from released detainees. They were not from Iraq, nor were they terrorists. They were picked up in Afghanistan and sold to us by Afghan War Lords. They were tortured, their lives ruined and in the end INNOCENT. MOST of the original 800 or so detainees have been released. There are approximately 270 remaining detainees in GITMO. Only 18 have been charged with a crime and now they will have the ability to hear the evidence against them. Somewhat.

We have prosecuted terrorism in the United States repeatedly. Most notably, The Blind Sheik who bombed the World Trade Center in 1993 and of course, Timothy McVeigh. America has never been afraid to prosecute people we dislike or even people we hate who do horrific crimes.

There is no such thing as an “Unlawful Enemy Combatant” Bush just made up this “term of art” In every US war combatants where either POWs or civilians under Geneva. There is no class of people who can be held “indefinitely” without charges being brought against them. POWs are released after a war has ended. The “War on Terror” will never end, however you can not go to war against civilians.

So is there A WAR ON TERROR?

There are no American POWs being held by foreign countries. Is this really a War?

Many detainees have been released without proper charges being brought and without a determination of guilt. Some were dropped off in the middle of yet another foreign country with no means to get back to their country of origin. The release of detainees is not under Court jurisdiction therefore it is as haphazard as the decision to confine. The result is equally gross.

WE MUST SHUT DOWN GITMO and begin to charge and try criminals. We must use our Courts who can review evidence. If evidence supports detention then we hold suspects pending trial.

When you radicalize our justice system it benefits no one, accuses anyone and shames everyone.

However, I suspect the Bush folks like to disappear people, torture people and have the Powers of a King. There is no other explanation.

One of my pet peeves is the common misconception that the Geneva Conventions only protect those wearing uniforms and fighting in a national or organized army. NO!!!!!!! Geneva extends protections to all persons involved or effected by the conflict, regardless of a person's status. Geneva does extend certain protections to each category of persons and sets forth the definitions of those categories. But it does not exclude anyone. This is a common myth perpetrated by the right-wing criminals now running our government and their sycophantic followers.

Another myth(lie) was affirmed by Rumsfeld. He said that while Geneva did not apply to the prisoners at Guantanamo, the U.S. government was abiding by Geneva in their treatment of those prisoners anyway. WRONG on both counts.

Randi, I was pleased to see you post about this issue and I hope you will spell it out to your listeners in no uncertain terms today.

I have to say yesterday's show was one of the best RR's ever. thumbsup.gif So much useful information. It's on permanent residency on my iPod and iPhone. Just excellent. Pulitzer worthy. This is why RR rocks my world and why I'm such a wonkie fan of hers. I really don't think I made some pledge to suffer from the sins of Bush and Cheney. Maybe they don't consider John Q. Public to be part of the Chosen Ones ? Does wealth in itself make a person a Chosen One, and inheritor of the gold, I don't think so. So you know, the King aka POTUS may have inherited a resentment from his father (Hussein tried to kill my daddy) which has equated to about one-half million deaths now ? Is chaos a tool of the devil ? Is chaos evil ? I don't know, the Big bang theory of the universe is Chaos to Order so maybe these clowns are just trying to play God.

Now, I personally did not create this chaos, I can't change this chaos and I can barely cure myself from the effects of a former chaotic life. But, damn, I don't think anyone other than the powers that be ought to suffer from this chaos. Alot of people may disagree with Sistiani and al-Sadr but their sect does represent and demonstrate order and a desire to return to the Rule of Law in Iraq. That's interesting because Mesopatania is said to be the birthplace of the Rule of Law. Now you know Bush and Rice don't want anyone talking to their enemies especially Jimmy Carter. Thing about it is that me and a few others think that Cowboy Diplomacy is another tool of chaos. Some people think that modern society must be brought to the brink of extinction in order for change to occur. Well, they want their changes to occur through bully tactics not necessarily what is good for mankind or those outside the ticky tacky box known as Washington, D.C.

One time, something happened to me on the internet causing me to call the FBI, was a good samaritan call you understand. Well, I was told to contact local authorities. I told them that I contacted the FBI for a specific reason as the matter I was trying to report was under FBI jurisdiction according to federal statute. I was again told to contact local authorities. So, I just got in my car and after finding the nearest hidden field office of the FBI, I knocked on their door. The Agent answering the door said to me, "How did you find our office ?". I told him that the FBI can't hide too well. To make a long story short, myself being a John Q. Public was not served very well. To this day, I don't know if I was an unwilling victim of an internet prank or scam. I guess Robert S. Mueller III would tend to say "That's classified" even if the entire situation was bogus. Although maybe they would just blame it on me instead, they are like that you know.

What is my point here ? Well, I guess I don't have a warm and fuzzy feeling about any aspect of security coming from the Whitehouse through their cabinet to mainstreet America. And that problem has been amplified by the chaos rangers to include economic security, social security, the security afforded through home ownership to security on an international level through the value of the United States dollar and how that value relates directly as to how far I am able to pursue happiness in a family car. Not very far this summer vacation season considering fill-ups for travelling at 4 bux a gallon. Of course I will not forget about fellow American independent truck drivers who are really small business owners and the heart of America.

I don't know, maybe it is best that the King has spent the least amount of time actually occupying the Whitehouse than any other President in the history of the United States. Maybe it is good he has abused Air Force One, an asset really owned by the American public, for political and private reasons for over seven years now. Maybe it's good there is no real hand's on management practices by this chief executive. Who knows how much more chaos would have been created in the last seven years if the Captain was really at the helm steering this supertanker of fiascos through numerous manmade and natural disasters. It's good to be the King, I am jealous myself as I only have secondhand knoweledge that the Pope likes Strawberry Icecream.

Randi: Eddy (on Friday) deserves a bit of a break, getting confused by the Gitmo ruling. I believe he was trying to follow the logic of Scalia dissenting, regarding the sovereignty of Gitmo and if such is the case, maybe McCain would not be a qualified candidate for president. Of course congress has addressed the McCain case, while unprecedented Bush actions have not. I guess Eddy got lost in the irony. Of course Scalia was not part of the original unprecedented court that gave us the unprecededuncy.

BTW: I knew that you would end up, bigger and better after the AAR fiasco. I almost saw it as a conspiracy. Not that I knew their part in it, I felt you would end up on the better end of it.

We must always take the opportunity to remind people, it is not the judges or lawyers that allow criminals to be set free but lack of evidence or misuse of intelligence or vice versa. (Misuse of evidence and lack of intelligence.) And often both, and usually followed by and preempted by cover-up or leak. It is too bad we can not have the justice such as it is over there, over here, but here is the irony. That excuse for why they have to treat terrorists above the law, because we are victims of our freedoms, which they hate, somehow... (I almost made sense there but got a cramp.) But it seems that the excuse they give for terrorist being terrorists, that they take advantage of our freedoms, is their own excuse for... ( I think I am stuck in a vicious cycle.) Would a third time be the charm? It may be justice that there is no reason I should be able to could get out of the fallacy that their rhetoric has brought us.

BTW: new to the borg,(RR-MB) after the above(tangent= my post) I read the attached and find it pretty much in line. I just wanted to make a comment on the SCOTUS Gitmo ruling and the "deeply divided" - court (5-4?) Italics Sarcasm I did review this and tried to make it more clear, but it was very trying, and I actually tried the dictionary. But maybe these guys have given the old "college try" to put an end to the need to try anything, but seem to have explained or converted it to the new "terrorist try" or trial by...?

More from the borg as I reflect on the RR-MB rules of operation, as best I recall there is no bombing or some such reference to hit and run posts, but what with Newt Gingrich being a shill for the Rhetorical Chief, and McChange, here is a rhetorical bomb. If the law is used against terrorists, only Republicans will be above the law. Again I suffer a logical deficit trying to run up against the rhetoric on their side. But what really triggered this bomb was Randi saying he (Newt) really raised the bar for war mongers. I was going to disagree, but maybe I found the way out of this loopiness, as it was terrorists Newt and by association McCain, and by association Republicans, have actually lowered the bar for, so they don't have such a leap. And by lack of association the media and Democrats because they fear to leap.
