Full Version: Obama's Illinois vote on Born-Alive Infant Protection Act

Hello RR fans,

A few weeks back on RR's show, I heard her very susinctly address the smear/lie that Obama voted NOT to allow infants born alive after an abortion attempt to receive medical care.

I'm trying to combat this smear on another message board and am trying to get some facts. I know he voted "present" on the bill(s) but specifically, I'm looking for the proof that this protection was already on the books in Illinois and hence the bill(s) were unneccesary and that his "present" vote was benign because of that fact.

Section B Subsequent to the abortion, if a child is born alive, the physician required by Section 6(2)(a) to be in attendance shall exercise the same degree of professional skill, care and diligence to preserve the life and health of the child as would be required of a physician providing immediate medical care to a child born alive in the course of a pregnancy termination which was not an abortion. Any such physician who intentionally, knowingly, or recklessly violates Section 6(2) B: commits a Class 3 felony.

There was a bill in the IL legislature that Obama voted against. It was called the "Born Alive Act". It was a bill that stated if the abortion is botched the doctor can't continue to abort the baby. One of the reasons Obama sited for his not voting for the legislation was that the law was unnecessary because there were laws already on the books that covered this circumstance.

The bill was an attempt to bypass court rulings and mandate lifesaving measures for any aborted fetus that has a beating heart, pulsating umbilical cord or movement of voluntary muscles. Such a fetus would be deemed "born alive" and granted full human rights under the rejected legislation.

Also, I'm fairly confident that Obama voted "present" and didn't cast either a yay or nay vote on the Infant Born Alive Act. Some links that have been posted suggests that Obama was coached by NARAL to vote present for political reasons, e.g., to avoid the situation he's in now anyway with the religious right claiming he voted against a baby born alive.

But I'm sure had he voted for the Act he would now be accused of wasting taxpayer money on supporting a superfluous bill. rolleyes.gif

The full title of the Legislation is the Illinois Abortion Law of 1975. This takes you to the first page of the legislation.

The law mandated the presence of a pediatrician as well as the OB/GYN doing the abortion, "to care for the baby in case it was born alive," per my understanding.

Excessive and wasteful government regulation.
